Welcome to Toumpa (“we,” “our,” or “us”). These Terms & Conditions (“Terms”) set out the basis on which you may access and use our mobile application (the “App”) and related services.

By downloading, accessing, or using Toumpa, you agree to be bound by these Terms and our Privacy Policy. If you disagree, you must not use the App.

You are responsible for ensuring that your use of Toumpa complies with all applicable laws and regulations in your country of residence.

These Terms constitute a legally binding agreement between you and Toumpa.


Eligibility

You must be at least 18 years old to use Toumpa. By creating an account, you confirm that you meet this age requirement.

By registering, you represent and warrant that all information you provide is accurate, complete, and kept up to date at all times.

You may not use Toumpa if:

  • You have been previously suspended, banned, or removed from the Service.

  • It is unlawful to do so in your country of residence.

  • You are prohibited from receiving services of this nature under applicable laws or regulations.

We reserve the right, at our sole discretion, to refuse registration, restrict access, or suspend/terminate any account if eligibility requirements are not met, or if we reasonably believe your use of the App could harm Toumpa, other members, or the integrity of the Service.


Your Account

  • You are responsible for maintaining the confidentiality of your login details.

  • You are responsible for all activity under your account.

  • You agree not to share your password with others.

Safety Disclaimer

You acknowledge and agree that you make contact with other members entirely at your own risk.

You are legally responsible for your own actions while using Toumpa, including interactions both online and offline.

Toumpa Pty Ltd does not:

  • Conduct criminal background checks

  • Verify member identities

  • Guarantee that users comply with these Terms

  • Guarantee that users are truthful or who they claim to be

  • Guarantee your safety during interactions or meetups

Toumpa Pty Ltd is not responsible or liable for:

  • Members registering under false identities, creating fake profiles, or misrepresenting themselves.

  • Third-party access to your account caused by stolen or shared login details

  • Emotional distress, financial loss, physical harm, or damages resulting from other users

  • Anything arising from meetings, messages, or interactions with members

  • Any consequences from your decisions, actions, or communications on the App

Although we take reasonable steps to maintain safety and reduce fraudulent activity, we cannot guarantee that Toumpa will always be safe, secure, or free of harmful behavior.

You are urged to exercise caution when interacting with others, especially when meeting offline.


Community Standards

Toumpa is designed to be a safe, respectful, and enjoyable place for connection. By using the App, you agree that you will not:

  • Harass, threaten, stalk, or abuse other members.

  • Post, share, or send content that is offensive, hateful, discriminatory, sexually explicit, or otherwise unlawful.

  • Misrepresent your identity, impersonate another person, or create accounts on behalf of others.

  • Engage in fraudulent, misleading, or deceptive conduct.

  • Solicit money, financial details, or promote products/services without our prior consent.

  • Upload or distribute viruses, malware, or any harmful code.

  • Interfere with the security, integrity, or proper operation of the App.

  • Use Toumpa for any unlawful, commercial, or non-personal purposes.


Enforcement

  • Violation of these rules may result in warnings, content removal, suspension, or permanent termination of your account.

  • Toumpa reserves the right to review, monitor, and moderate User Content and activity on the App to enforce these Standards.

  • Serious or repeated violations may also result in referral to law enforcement or other appropriate authorities.

    Required Behaviour:

    • Use accurate information

    • Communicate respectfully

    • Report harmful or suspicious behavior

    • Follow all applicable laws

    • Violation of these rules may result in account restriction, suspension, or permanent termination.

    Termination

    • We may suspend or terminate your access if you breach these Terms. Toumpa may also suspend or terminate any account at any time, with or without notice, and for any reason, to the extent permitted by law, including where we reasonably believe such action is necessary to protect Toumpa, its users, or the integrity of the Service.

    • Upon termination, your content may be removed, except where we are required by law to retain it.


User Content & Licensing

  • You may upload or share content such as profile photos, answers, comments, and messages (“User Content”). You remain the owner of your User Content.

  • By uploading or sharing User Content on Toumpa, you grant Toumpa Pty Ltd a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to use, host, store, reproduce, display, adapt, publish, and distribute such content within the App for the purpose of providing and improving our services.

  • You represent and warrant that:

    • You own or have the necessary rights to share your User Content.

    • Your User Content does not infringe the rights of any third party (including intellectual property, privacy, or publicity rights).

    • Your User Content complies with these Terms and our Community Standards.

  • You are solely responsible for your User Content. Suppose a claim is made against Toumpa in connection with your User Content. In that case, you agree to indemnify and hold Toumpa harmless from all damages, costs, and expenses (including reasonable legal fees).

  • We reserve the right to review, remove, or restrict any User Content that we reasonably believe breaches these Terms, our Community Standards, or applicable law.

  • Toumpa has no obligation to store, maintain, or provide you with a copy of any User Content once it is deleted, either by you or by us.


Safety, Liability & International Access

You make contact with other members entirely at your own risk, and you are legally responsible for your own actions when using Toumpa, both online and offline.

Toumpa does not guarantee that members comply with these Terms, nor do we verify user identities or conduct criminal background checks. We are not responsible for the actions of any member, including but not limited to:

  • Members registering under false identities or misrepresentation.

  • Third-party access to your account resulting from theft or misuse of your login details.

  • Any injury, emotional distress, financial loss, or harm arising from interactions with other members.

  • Unauthorised users, fraudulent accounts, or impersonators.

While we take reasonable steps to monitor safety and reduce fraudulent activity, we cannot guarantee that Toumpa will always be safe, free of unlawful activity, or error-free. You should exercise caution when sharing information on the App and when deciding whether to meet other members in person.

It is also possible that members from outside Australia may access the Service, and in some cases, it may not be practicable for Toumpa to enforce these Terms against such members. Suppose Toumpa receives a complaint alleging that a member has breached these Terms. In that case, Toumpa may investigate the matter and, at its discretion, take action, including suspending or terminating that member’s access to the Service. However, Toumpa is under no obligation to investigate or act on every complaint received.


Privacy

Your personal information is handled in accordance with our [Privacy Policy]. By using Toumpa, you consent to the collection, use, and disclosure of your information as described in that policy.

You agree that we may process your personal information to operate and improve the App, provide matching services, ensure safety, comply with legal obligations, and communicate with you about your account.

If you disagree with how your information is handled, you must stop using Toumpa and delete your account.


Payments (if applicable)

  • Some features may be offered on a paid subscription basis. The details of pricing, features, and duration will be displayed within the App.

  • Subscriptions are billed through your app store account (Apple App Store or Google Play). You are responsible for ensuring your payment details are accurate and up to date.

  • Subscriptions will automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal through your app store account settings.

  • Payments are non-refundable except where required by law (including under the Australian Consumer Law).

  • If you delete the App or your account, your subscription will not automatically be cancelled — you must cancel it through your app store to avoid further charges.

  • Toumpa reserves the right to change pricing or subscription features at any time. Any price changes will take effect at the start of the next billing cycle and will be communicated in advance where required.


Intellectual Property

All rights, title, and interest in Toumpa and its content — including but not limited to the design, software, algorithms, questionnaires, branding, trademarks, logos, text, graphics, and other materials — are owned by Toumpa or our licensors.

Except as expressly permitted in these Terms, you may not:

  • Copy, modify, distribute, or reproduce any part of the App or its content.

  • Reverse-engineer, decompile, or attempt to extract source code.

  • Use Toumpa’s name, logo, or branding without prior written consent.

  • Create derivative works based on Toumpa’s content, features, or services.

All intellectual property rights are reserved. Nothing in these Terms grants you any right or licence to use Toumpa’s intellectual property except as necessary to use the Service in accordance with these Terms.


Availability & Updates

We strive to keep the App available and functioning smoothly, but we do not guarantee uninterrupted, timely, secure, or error-free access. The App may occasionally be unavailable due to maintenance, technical issues, or circumstances beyond our control.

We reserve the right to update, modify, suspend, or discontinue the App (or any part of it) at any time without liability to you. Specific updates may be required to continue using the App, and by using Toumpa, you agree to install such updates when provided.

Toumpa Pty Ltd is not responsible for:

  • Any interruptions, delays, errors, or technical malfunctions.

  • Loss of data, messages, or content due to outages or updates.

  • Compatibility issues with devices, operating systems, or third-party software.

Nothing in these Terms guarantees continuous or permanent availability of the App, and we may discontinue certain features or services at our discretion.


Modification of Terms

Toumpa may update, amend, or replace these Terms from time to time. Any changes will take effect once published within the App or on our website, unless a later effective date is stated.

It is your responsibility to review the Terms periodically to stay informed of any updates. Continued use of Toumpa after changes take effect constitutes your acceptance of the revised Terms.

If the changes are material, we may also notify you by email, in-app notification, or other reasonable means.


Communication & Notifications

By using Toumpa, you consent to receiving electronic communications from us, including emails, in-app notifications, SMS, and alerts. These communications may include essential updates about your account, safety notices, service announcements, promotional content, and changes to these Terms.

You acknowledge that certain communications are essential for the proper operation of the Service (such as safety alerts, account verification, and legal notices), and you cannot opt out of receiving them.

For optional communications, such as marketing or promotional messages, you may opt out at any time by following the unsubscribe instructions included in the message or adjusting your settings within the App.

All communications will be deemed received once we send them, regardless of whether you read them.


Limitation of Liability

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Toumpa shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to loss of profits, loss of data, loss of goodwill, or other intangible losses, even if Toumpa has been advised of the possibility of such damages.

Any liability Toumpa may have to you, whether arising in contract, tort (including negligence), statute, or otherwise, is limited to the total amount of fees (if any) paid by you to Toumpa in the 12 months immediately preceding the claim.

Toumpa is not responsible for:

  • User behaviour or interactions, whether online or offline.

  • Failed matches, missed connections, or dissatisfaction with compatibility results.

  • Technical issues, interruptions, errors, delays, or bugs in the App.

  • Unauthorised access, use, or alteration of your data by third parties.

  • The acts, omissions, or failures of any third-party services (including app stores, hosting providers, or payment processors) that Toumpa relies on.

Toumpa shall not be liable for any failure or delay caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, internet or power outages, labour disputes, cyberattacks, or failures of telecommunications networks (“Force Majeure”).

Nothing in these Terms excludes or limits any rights, guarantees, or remedies you may have under the Australian Consumer Law or other applicable legislation that cannot be lawfully excluded or limited.


No Guarantee of Matches

Toumpa does not guarantee the accuracy of matches or the formation of friendships, relationships, or any other type of connection through the Service. Outcomes depend on user participation, honesty, preferences, and compatibility factors outside Toumpa’s control.

Toumpa’s matching features are based on automated algorithms and user-provided information. We do not guarantee the accuracy, completeness, or suitability of any match or compatibility result.

You acknowledge and agree that:

  • Any matches or connections suggested by the App are based on algorithms and user-provided information, which may be incomplete, inaccurate, or misleading.

  • Toumpa is not responsible for the behaviour, actions, or intentions of other members.

  • Success in forming meaningful connections cannot be assured, and Toumpa makes no promises or warranties regarding the likelihood of success.


Dispute Resolution & Class Action Waiver

Before commencing any legal proceedings, you agree to attempt to resolve any dispute arising out of or relating to these Terms or the Service through good-faith negotiation or mediation.

To the extent permitted by law, any dispute not resolved through mediation shall be resolved on an individual basis only, and not in a class, consolidated, representative, or collective action, and you waive any right to participate in such proceedings against Toumpa.


Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia, without regard to conflict of law principles.

You agree that any disputes, claims, or proceedings arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

If you access Toumpa from outside Australia, you are responsible for complying with local laws, and you waive any objection to the jurisdiction and venue of the courts of New South Wales.

No Professional Advice

Toumpa does not provide medical, psychological, therapeutic, legal, or professional advice. Any content, questions, prompts, or matching suggestions within the App are for informational and entertainment purposes only. You should not rely on Toumpa as a substitute for professional guidance, diagnosis, or treatment. Any decisions you make based on information within the App are your sole responsibility.

Third-Party Links & Services

Toumpa may include links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party service. Your interactions with third-party platforms (including app stores, payment processors, or external websites) are solely between you and those providers.

Survival

Any sections of these Terms that by their nature should survive termination (including Intellectual Property, User Content & Licensing, Safety Disclaimer, Limitation of Liability, and Governing Law) shall remain in full force after your account is closed or access to the Service ends.
